Developing Constitutional Review in China: A Comparative Perspective

Like many countries, China has a written constitution. Unlike some of these countries, there is no form of judicial review in China. Thus, the Chinese Constitution is not justiciable, making its provisions a law in the books but not a law in action. China needs to consider whether to join the group of countries with judicial review. My research will focus on whether and how judicial review could be implemented in China, comparing the best practices and outcomes from countries such as France, Germany, Hong Kong, Japan, South Korea, Taiwan, and the United States.
